The High Court has refused an application by a health professional to terminate an Interim Suspension Order imposed by the Health and Care Professions Council (HCPC), confirming that the order should remain in place pending the conclusion of fitness to practise proceedings.
In LMN v Health and Care Professions Council [2026] EWHC 1860 (Admin), handed down on 21 July 2026, the Administrative Court considered an application under the statutory provisions permitting the Court to review interim orders made by the HCPC.
The applicant, anonymised as LMN, sought to bring an end to an Interim Suspension Order that had been imposed while the HCPC’s substantive fitness to practise proceedings remained ongoing. By the time of the application, the suspension had been in place for approximately 16 months.
The Court considered whether the statutory criteria for maintaining the Interim Suspension Order continued to be satisfied. Interim orders are intended to protect the public, maintain confidence in the profession and the regulatory process, and uphold proper professional standards while allegations are investigated and determined. They are not disciplinary sanctions and do not determine whether the underlying allegations are proved.
After considering the submissions, the High Court declined to terminate the Interim Suspension Order. The Court concluded that the grounds for continuing the order remained established and that it should remain in force pending the outcome of the substantive fitness to practise proceedings.
