Social Work England has released final guidance to support the introduction of its adjudicator consensual disposal process, a new mechanism designed to resolve certain fitness‑to‑practise cases more efficiently. The process, which comes into effect on 1 April 2026, will allow Social Work England and a social worker to agree the facts, impairment and proposed sanction in cases that have already reached the final hearing stage. Any agreement will still require approval from an independent adjudicator.
The regulator says the new approach is intended to streamline case resolution where both parties are aligned, reducing delays and improving the overall experience for those involved in the fitness‑to‑practise system. Alongside the guidance, Social Work England has published process maps and an accessible version to help social workers and the public understand how the new route will operate.
The final guidance follows a public consultation held late last year, which focused on clarity, accessibility and the potential impact on people with protected characteristics. Respondents highlighted the need for straightforward language and transparency. Social Work England says it has refined the guidance in response to this feedback, and has also published a full consultation response outlining the changes made.
The new guidance will take effect from April 2026, when the adjudicator consensual disposal process formally launches.
