Kings View Chambers discusses Suresh & Ors v GMC where the High Court examined the GMC’s duty of care and Human Rights Act obligations for doctors under investigation.

The Court concluded that the Tribunal had not erred in finding that Dr Ahmedsowida’s fitness to practise was impaired, and that the 12-month suspension was an appropriate sanction.

The Court determined that the sanction was proportionate to the misconduct, and that the necessity to protect patient safety and maintain public trust in the regulatory system.

The GMC has lost an appeal against a suspension sanction imposes by a Medical Practitioners’ Tribunal.
